Land & Property Rights in Israel
Legal Guidance for Landowners, Co-Owners and Overseas Property Owners
Land ownership in Israel can involve legal structures that are very different from ownership of a registered apartment. This is particularly true where land is held by several owners in undivided shares or where future planning and development may affect the practical value of the rights.
Understanding What You Own
The starting point is to understand the registered rights, the size and nature of the share, existing agreements and restrictions, and how the rights relate to the land as a whole.
Undivided Ownership — Musha
In undivided co-ownership, a registered percentage does not necessarily identify a specific physical part of the parcel. The legal and practical implications should be understood before buying, selling or entering arrangements with other owners.
Co-Ownership Agreements
A co-ownership agreement can regulate use, allocation, decision-making, expenses, transfers and future development between rights holders, depending on the property and the parties’ objectives.
Organising Groups of Landowners
I have substantial experience working with groups of rights holders, including the legal arrangements required to organise owners and create a framework for cooperation.
From Organising Owners to Registration
Where owners proceed with a development project, I provide legal representation in connection with the agreements with the developer and the legal aspects of the project, working alongside the owners’ representatives and, where applicable, the project management company.
My legal involvement may continue throughout the project, from the organisation of the owners and the initial agreements through the development process and ultimately to the registration of the resulting rights.
Israeli Land Owned From Abroad
Overseas owners may need assistance understanding, protecting, transferring or developing Israeli land rights, often without being physically present in Israel for each stage.
